WSDOT sues STP over tunnel project

The Washington State Department of Transportation said Friday it has filed a lawsuit in King County Superior Court against Seattle Tunnel Partners, the contractor building the replacement tunnel for the Alaskan Way Viaduct.

A WSDOT news release said the filing was prompted by recent court filings by STP and its insurance companies. It said filing the lawsuit against STP ensures WSDOT will have a right to make legal claims in the future.

WSDOT also said its lawsuit does not prevent STP from pursuing claims under the terms of the project's design-build contract.

WSDOT said its focus remains on completing the project, and removing the seismically vulnerable viaduct. To keep the project moving, WSDOT said it will ask for a stay of its lawsuit until the project is finished and requested that STP do the same.

The new release said the lawsuit was filed to protect Washington taxpayers.

The latest project schedule indicates the replacement tunnel will open to traffic on March 9, 2018 — more than two years behind schedule.

The case number is 15-2-24943-6 SEA.
