ARLINGTON, Va. — The Associated General Contractors of America and several employer groups filed a lawsuit this week to block the U.S. Environmental Protection Agency and the Army Corps of Engineers' Waters of the U.S. rule. The organizations claim the new rule violates the Clean Water Act, the Administrative Procedures Act, and the U.S. Constitution's due process and commerce clauses.
“Just because a piece of land occasionally gets wet doesn't make it a navigable waterway,” said AGC CEO Stephen E. Sandherr in a news release. “Try as it might, the administration cannot redefine the reality of existing law or constitutional limits on executive power.”
