Andrew Bergh: When does employee 'assume the risk' of job?

Most Washingtonians can't sue their employers for negligence. Instead, their so-called “exclusive remedy” for on-the-job injuries is a claim for worker's compensation benefits.

But police officers enjoy a much sweeter deal. Under their statutory plan, law enforcement personnel can sue their employer for negligence if their damages exceed the amount of worker's compensation benefits they received.
