JUNEAU, Alaska (AP) — A federal appeals court last Friday stated its intention to find that Kensington Mine's plan to dispose of its production waste, or tailings, in a freshwater lake north of Juneau is illegal.
The 9th U.S. Circuit Court of Appeals in San Francisco tipped its hand when ruling on an emergency request that would allow mine developer Coeur Alaska Inc. to build a diversion ditch that would handle runoff from snow melt and spring rains at the proposed mine tailings site.
