State lawmakers are considering a bill that would clarify reporting requirements, liability and response times when human remains are found during construction. The bill has passed the House and is in the Senate Ways and Means Committee.
Sponsors of the bill said current law does not make it clear that such findings must be immediately reported. They said current law can also make landowners or developers liable for the costs of excavation or for other liability related to the finding. The law is also unclear, they say, on what should happen once remains have been reported.
